Workers’ Compensation insurance is a type of coverage which provides protection for employees who are injured as a result of their employment. It does not provide benefits to employees who suffer non-work related injuries. This type of insurance coverage also protects an employer against further legal action that an injured employee (or dependents) might pursue against the employer.
Workers’ Compensation laws impose an obligation on the employer for benefits to injured employees. These laws were created due to the industrialization of our economy where employment related industries increased in severity and frequency. Some things to keep in mind about workers’ comp insurance:
Negligence is not a factor in determining liability for bodily injuries sustained by an employee.
- The cost of the coverage is paid by the employer, not the employee.
- Self inflicted injuries are not covered.
- Provides coverage for occupational disease (for example exposure to asbestos which later results in cancer).
- Benefits the injured worker may be entitled to include: medical expenses, lost income, funeral expense and rehabilitation costs.
- Also can provide protection for third party legal suits against the employer.
